VIC:Tobacco co fight over plain packaging

A big tobacco company is in the Federal Court fighting the federal government's refusal
to release legal advice on the plain packaging of cigarettes.

British American Tobacco Australia (BATA) wants access to legal advice obtained by
the Department of Health in 1995.

An appeal hearing is under way in Melbourne as BATA fights the government over a legal
document regarding plain packaging.

The government has refused to release the legal advice through Freedom of Information,
a position backed up by the Administrative Appeals Tribunal.
